DMCA & INTELLECTUAL PROPERTY POLICY
Last Updated: August 19, 2026
Azhawaiian respects the intellectual property rights of artists, designers, creators, brands, photographers, and other rights holders.
This DMCA & Intellectual Property Policy explains how copyright, trademark, and other intellectual property concerns relating to content available on azhawaiian.com may be reported to us.
1. RESPECT FOR INTELLECTUAL PROPERTY
Azhawaiian is committed to respecting valid intellectual property rights.
Intellectual property may include, where applicable:
- Copyrights
- Trademarks
- Trade dress
- Logos
- Artwork
- Photographs
- Illustrations
- Graphics
- Product designs
- Written content
- Other legally protected materials
We may review, remove, disable, decline, or discontinue content or products when we reasonably believe they may infringe another party's intellectual property rights or when otherwise required by applicable law.
Shopify likewise prohibits content that infringes the legal rights of others and provides procedures for reporting intellectual-property concerns involving Shopify stores.
2. AZHAWAIIAN CONTENT
Unless otherwise stated, content owned by Azhawaiian or used by Azhawaiian with appropriate authorization may include:
- Original artwork
- Product designs
- Product photographs
- Product mockups
- Graphics
- Videos
- Website text
- Promotional materials
- Azhawaiian branding
- Other original creative content
Such content may be protected by applicable copyright, trademark, and other intellectual property laws.
You may not reproduce, republish, distribute, sell, commercially exploit, or create unauthorized derivative works from protected Azhawaiian content without permission from the applicable rights holder.
3. CUSTOMER-SUBMITTED CONTENT
Certain personalized or customized Azhawaiian products may allow customers to submit content such as:
- Photographs
- Artwork
- Images
- Names
- Dates
- Text
- Logos
- Other personalization materials
By submitting content to Azhawaiian for use in an order, you represent that you either:
- Own the necessary rights to the submitted content, or
- Have appropriate permission or authorization to use the content for the requested product.
Submitting content to Azhawaiian does not transfer ownership of your intellectual property to us.
You grant Azhawaiian and our production partners limited permission to use the submitted content only as reasonably necessary to:
- Prepare the requested design
- Produce the requested product
- Fulfill and deliver the order
- Provide related customer support
Azhawaiian may decline or cancel a personalization request if we reasonably believe the submitted content infringes intellectual property rights, violates applicable law, or violates our Terms of Service.
4. REPORTING COPYRIGHT INFRINGEMENT
If you believe that content available through Azhawaiian infringes a copyright that you own or are authorized to enforce, please send us a written copyright infringement notice.
To help us review your complaint, please provide:
- Your full legal name
- Your email address and contact information
- Identification of the copyrighted work you believe has been infringed
- Identification of the allegedly infringing material
- The specific Azhawaiian URL where the material appears
- Information reasonably sufficient for us to locate the material
- Information showing your ownership or authority to act on behalf of the copyright owner
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law
- A statement that the information in your notice is accurate
- A statement, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the copyright owner
- Your physical or electronic signature
These elements are consistent with the information required for a DMCA takedown notice under Section 512.

6. HOW WE HANDLE COPYRIGHT COMPLAINTS
After receiving a sufficiently detailed copyright complaint, Azhawaiian may:
- Review the identified content
- Request additional information
- Temporarily disable or remove content where appropriate
- Review the relevant product or listing
- Contact relevant parties where appropriate
- Decline or discontinue affected products
- Cancel affected personalization requests where appropriate
- Take other reasonable action based on the circumstances and applicable law
Submitting a complaint does not automatically guarantee removal of the identified material.
We may be unable to act on complaints that are incomplete, unsupported, fraudulent, abusive, or that do not sufficiently identify the allegedly infringing material.
7. FALSE OR MISLEADING COPYRIGHT CLAIMS
Please submit a copyright complaint only when you have a genuine basis for believing that infringement has occurred.
Copyright notices should be complete, truthful, and submitted in good faith.
Knowingly making material misrepresentations in a DMCA notice or counter-notice can have legal consequences under U.S. copyright law.
If you are uncertain whether particular content infringes your rights, you may wish to obtain independent legal advice before submitting a formal complaint.
8. COUNTER-NOTICES
If content associated with you has been removed or disabled because of a copyright complaint and you believe the removal resulted from a mistake or misidentification, you may contact Azhawaiian using the information provided in this policy.
Where an applicable DMCA counter-notification procedure applies, a valid counter-notice may require information including:
- Your full legal name
- Your physical or electronic signature
- Identification of the material that was removed or disabled
- The location where the material appeared before it was removed
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled because of mistake or misidentification
- Your address
- Your telephone number
- Any jurisdiction and service-of-process statements required by applicable law
We may request additional information or provide further instructions depending on the circumstances.
The U.S. Copyright Office recognizes counter-notification as part of the Section 512 notice-and-takedown framework.
9. TRADEMARK AND TRADE DRESS COMPLAINTS

This should generally include:
- The type of intellectual property right involved

Depending on the circumstances, this may include:
- Refusing submitted content
- Removing affected material
- Declining personalization requests
- Canceling affected orders
- Restricting future content submissions
- Taking other appropriate action permitted by applicable law or our Terms of Service
12. SHOPIFY INTELLECTUAL PROPERTY REPORTING
Azhawaiian operates on Shopify's ecommerce platform.
Rights holders may also have the option to report copyright, trademark, or trade-dress concerns directly through Shopify's intellectual property reporting procedures.
A complaint submitted directly to Shopify is handled according to Shopify's own policies and is separate from a complaint submitted directly to Azhawaiian. Shopify provides dedicated copyright and trademark reporting mechanisms for Shopify-powered stores.
13. NO TRANSFER OF INTELLECTUAL PROPERTY RIGHTS
Nothing in this policy transfers ownership of:
- Customer-submitted content to Azhawaiian
- Azhawaiian-owned content to customers
- Third-party intellectual property to Azhawaiian or customers
Intellectual property rights remain with their respective rights holders unless otherwise agreed in writing.
14. CHANGES TO THIS POLICY
We may update this DMCA & Intellectual Property Policy from time to time to reflect changes to:
- Our website
- Business practices
- Intellectual property procedures
- Applicable legal requirements
The latest version will be published on this page with an updated Last Updated date.
